Terms and Conditions

This Services Agreement (the "Agreement") constitutes the complete terms and conditions governing your subscription to Website Design, Development, and other Internet-related services provided by Five Design (the "Services"). As referenced in this Agreement, "Client," "you," or "your" refers to you.

By engaging with our Services, you acknowledge that you have thoroughly reviewed this Agreement and agree to its terms and conditions, as well as all policies posted on our website.

Throughout this Agreement, the term "Site" refers to a World Wide Web site, and "Five Design Site" refers to the website located at the URL https://fivedesign.in or any other successor sites owned or maintained by Five Design.

The following terms and conditions govern all website development/design services provided by Five Design to the Client.

Acceptance

Client acceptance of the terms and conditions outlined herein is implied upon acceptance of a project quotation. It is not mandatory for the Client to sign a formal acceptance document; rather, acceptance occurs upon the Client's agreement to a provided quote. By accepting a quote, the Client acknowledges having reviewed and accepted these terms and conditions in their entirety.

Please review these terms and conditions carefully. Any purchase or use of our services indicates your acknowledgment and acceptance of these terms and conditions.

Charges

Charges for services rendered by Five Design are detailed in the project quotation sent to the Client via email. Quotations remain valid for a period of 30 days. Five Design reserves the right to modify or decline to provide a quotation after this 30-day period has elapsed.

Unless otherwise arranged with the Client, all website design services require an initial payment of at least fifty (50) percent of the total project quotation before work commences. The remaining fifty (50) percent of the project quotation total is due upon completion of the work, prior to uploading to the server or release of materials.

Payment for services must be made via cash, cheque or bank transfer. Cheques should be made payable to Five Design and sent to our designated address. Bank details will be provided on invoices.

Website Contents

Five Design requires the Client to provide all necessary information in advance.

Note: Text content should be submitted as a Microsoft Word, email, or similar document, with each page representing the content of the relevant pages on your website.

Client Review

Five Design will afford the Client an opportunity to review the appearance and content of the website during the design phase and upon completion of the overall website development. Upon project completion, all materials will be deemed accepted and approved unless the Client notifies Five Design otherwise within fourteen (14) days of the date the materials are made available to the Client.

Turnaround Time and Content Control

Five Design will install and publicly post or supply the Client's website by the date specified in the project proposal, or on a date agreed upon with the Client upon Five Design receiving the initial payment. This timeline may be delayed only if specifically requested by the Client and agreed upon by Five Design.

Throughout the project, Five Design will require the Client to provide website content, including text, images, videos, and sound files.

Termination of Agreement

Five Design requires the Client's active participation in the project by providing necessary information, feedback, and approvals promptly. If the Client fails to do so within three months of project commencement, Five Design reserves the right to close the project, terminate this agreement, and release both parties from their respective obligations. However, any termination of the agreement will not relieve the Client of their obligation to pay for services rendered up to the date of termination.

Payment

Invoices will be issued by Five Design upon completion of the project but before publishing the live website. These invoices are typically sent via email, although the Client may request hard copies if preferred. Payment for invoices is due upon receipt.

Additional Expenses

The Client agrees to reimburse Five Design for any additional expenses incurred in completing the work. Such expenses may include the purchase of special fonts, stock photography, extra entries.

Web Browsers

Five Design strives to ensure that websites are designed to be compatible with the majority of visitors' browsers. Websites are optimized to function with popular current browsers such as Firefox, Internet Explorer, Google Chrome, etc. However, the Client acknowledges that Five Design cannot guarantee correct functionality across all browser software and different operating systems.

Termination

If the Client wishes to terminate services, they must submit a written notice of termination. Such termination will be effective upon receipt of the written notice. Requests for termination via telephone will not be considered valid unless confirmed in writing. The Client will be invoiced for work completed up to the date of the first notice of cancellation and must make payment in full within thirty (30) days.

Copyright

The Client retains the copyright to all data, files, and graphic logos provided by the Client. By providing such material, the Client grants Five Design the right to publish and use it. The Client is responsible for obtaining permission and rights to use any copyrighted information or files belonging to third parties.

Design Credit

A link to Five Design will appear in either small type or by a small graphic at the bottom of the Client's website. If a graphic is used, it will be designed to fit in with the overall site design. The Client also agrees that the website developed for the Client may be presented in Five Design’s portfolio.

General

These Terms and Conditions override all prior representations, understandings, or agreements. The Client's signature below or payment of an advance fee signifies agreement to and acceptance of these Terms and Conditions. Payment made online constitutes acceptance of our terms and conditions.
